Description
Council is proposing a resolution: 'That all drainage reserves vested in Council on registration of subdivision plans be classified as Operational Land'.
Classification of drainage reserves to operational land will help maintain a drainage network that efficiently manages the capturing and dissipation of storm water and minimises the risk to property and the public.
Section 51 of the Local Government Act 1993 notes that land held by Council for drainage purposes may be used for any other purpose that is not inconsistent with its use for drainage purposes, and proper maintenance of drainage reserves may also provide safe passive recreation and access for pedestrian movement by connecting key community services and facilities, without the need for a Plan of Management for the land.
Section 34 of the Local Government Act requires a minimum of 28 days public exhibition of a proposed resolution to classify public land during which submissions may be made to Council.
